Town of Hempstead Permits & Violations

Town of Hempstead permit expediting, Nassau County

Common Permits needed in the Town of Hempstead

Homeowners and businesses in the Town of Hempstead typically need permits for building construction (e.g., adding an extension to a home), plumbing work (e.g., installing a new bathroom), rental properties (e.g., obtaining a rental occupancy permit), and public assembly (e.g., holding an event in a commercial space). Ensuring proper permits are obtained helps maintain safety and compliance. Violations such as illegal housing, construction without permits, or unapproved structural changes may lead to fines, legal trouble, or unsafe conditions.

Risks of Not Closing Permits in the Town of Hempstead

Failing to close permits can lead to serious complications, such as fines, being unable to sell a property, or facing legal repercussions. For example, a homeowner in Hempstead who failed to close a permit for a basement renovation faced delays in selling their home, as they had to complete additional inspections and pay fines to meet code requirements before the sale could proceed. Building codes are crucial to the safety of homes and commercial spaces in Hempstead. These codes ensure that constructions are safe for occupancy, reducing risks of injury or damage. Non-compliance can put residents and communities at risk, which is why it is critical to adhere to these standards.

History of Building Codes in the United States

Building codes in the United States date back to the early 20th century, primarily introduced to safeguard the health and safety of residents. These regulations were designed to create consistency and establish minimum standards for construction quality, energy efficiency, fire safety, and accessibility. The first building codes focused largely on fire safety, following disastrous urban fires in the late 19th century. Over time, building codes evolved to address new technologies, natural disaster preparedness, and community needs, such as structural safety, electrical standards, and environmental sustainability. In recent decades, codes have increasingly emphasized energy efficiency and green building practices to reduce environmental impacts. Today, building codes help ensure that every structure is safe, sustainable, accessible, and resilient, keeping up with innovations in construction materials and techniques.

Town of Hempstead Rental Permit: How to Get One

Renting out a house or apartment in the unincorporated Town of Hempstead? Town Code Chapter 99 requires a rental occupancy permit from the Department of Buildings before a tenant moves in. It's issued only to the owner, lasts two years and doesn't transfer. Rentals under 28 nights aren't allowed.

In an incorporated village like Freeport, Garden City or Lynbrook? Your village has its own rental rules.

How to get a rental permit:

1. Check your records. You need a Certificate of Occupancy or Compliance and permits for every structure. Open permits or violations can hold up approval.

2. Gather your documents.

3. Complete the Town's Rental Property Registration form, signed under oath and notarized.

4. File it with the Building Department. Town fees apply.

5. Pass the on-site inspection of each rental unit.

6. Renew every two years, at least 60 days before your permit expires.

What you'll need:

- Name, address and phone of every owner (or each principal of an owning LLC or corp.)

- Proof of residency for each owner

- Tax map section, block and lot

- Floor plan with each room's use and size

- Number of units and occupants per unit

- Recent certified deed and tax bill

- Certificate of Occupancy or Compliance

- Survey or scaled site plan, including parking

- Building permits for all structures

- Carbon monoxide alarm certificate of installation

- A Nassau County agent for notices, if you live outside the county

How long does it take?

It varies with how complete your file is, the inspection schedule, and whether open permits or violations need to be cleared first.

Can I use the seller's permit?

No. Rental permits don't transfer. New owners must register within 30 days of closing.

What if I rent without one?

It's a violation. Fines increase with repeat offenses, each day can count separately, and late charges apply. Advertising an unpermitted rental is also a violation.

Does a mother-daughter unit need one?

Not if you hold a Town mother-daughter permit. Those don't transfer when a property is sold, so new owners need their own. We handle those too.

Open permits, violations or a missing CO holding up your rental permit? We can clear those first. Free consultation & quote. Call or text 516-399-0139 — we usually reply within an hour or two.
